Risks involved practicing Nunchaku-do

By participating in activities described herein, you agee, on behalf of yourself and your heirs, personal representatives, successors and assigns:

  • That the martial art Nunchaku-do, and practicing and applying the techniques shown here, is inherently dangerous. The techniques shown here may cause significant and unintended injuries if applied or practiced incorrectly or in a careless manner.

  • That personal instruction by a qualified instructor is a preferred and potentially safer method of learning martial arts and personal defense techniques.

  • That while practicing these techniques you must be careful to avoid strong pressure and damage to sensitive areas, including but not limited to eyes, throat, face, back and groin.

  • That you assume all risks of visiting this site, including but not limited to all risks, whether or not specifically mentioned in this site, of practicing, applying, using and/or trying to use the techniques shown in this site.

  • That you waive, release and discharge any and all claims of damages for death, personal injury or property damage which you may have, or which you may have in the future, as a result of your membership in this site and/or practicing, applying, using and/or trying to use the techniques shown in this site.

  • That you agree to indemnify and hold  the WNA harmless and everyone appearing in or associated with this site, against all claims, losses, damages and expenses, including but not limited to attorneys' fees and costs, whether asserted by you or anyone else, resulting from any loss or injury to person or property, arising from or associated with your membership in this site or your practice, application, use and/or attempt to use the techniques shown in this site.

 2. Privacy Policy

What This Privacy Policy Covers

  • This policy covers how the World Nunchaku Association (WNA) treats personal information that the WNA collects and receives. Personal information is information about you that is personally identifiable like your name, address, email address, or phone number, and that is not otherwise publicly available.
  • This policy does not apply to the practices of companies that the WNA does not own or control, or to people that the WNA does not employ or manage. In addition, certainn associated partners such as www.nunchaku.com have their own privacy statements which can be viewed on their websites.

Information Collection and Use

  • The WNA collects personal information when you create a profile, when you visit the pages of nunchaku.org or the pages of certain partners, and when you enter promotions or sweepstakes. The WNA may combine information about you, with information obtained from partners or other companies.
  • When you create a profile we ask for information such as your name, email address, birth date, gender, city and personal interests. Once you have created your profile, you are not anonymous to us.
  • The WNA collects information about your transactions with some of our partners.
  • The WNA automatically receives and records information on our server logs from your browser, including your IP address, cookie information, and the page you request.
  • The WNA uses information for the following general purposes: to customize the content you see, improve our services, contact you, conduct research, and provide anonymous reporting for internal and external clients.

Information Sharing and Disclosure

The WNA does not rent, sell, or share personal information about you with other people or nonaffiliated companies except when we have your permission, or under the following circumstances:

  • We provide the information to trusted partners who work on behalf of or with the WNA under confidentiality agreements. These companies may use your personal information to help the WNA communicate with you about offers and direct mailings. However, these companies do not have any independent right to share this information.
  • We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.
  • We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the Rules of Conduct or the Copyright Notice, or as otherwise required by law.
  • We transfer information about you if the WNA is acquired by or merged with another organization. In this event, the WNA will notify you before information about you is transferred and becomes subject to a different privacy policy.

Your ability to edit your profile

  • You can edit your personal profile at any time.
  • We reserve the right to send you certain communications relating to the the WNA service, such as service announcements and administrative messages, that are considered part of your the WNA profile, without offering you the opportunity to opt-out of receiving them.
  • If you wish to delete your profile, you can delete all your personal information for your profile by editing it. However, your memberID and password can not be deleted.

Confidentiality and Security

  • We limit access to personal information about you to organization members who we believe reasonably need to come into contact with that information to provide service or in order to do their jobs.
  • We have physical, electronic, and procedural safeguards to protect personal information about you.

Changes to this Privacy Policy

  • The WNA may update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your the WNA profile or by placing a prominent notice on our site.

3. Rules of Conduct for the Interactive Area

You agree to not use the Interactive Area to:

  1. upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
  2. harm minors in any way;
  3. impersonate any person or entity, including, but not limited to, a WNA official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  4. forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Interactive Area;
  5. upload, post, email, transmit or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
  6. upload, post, email, transmit or otherwise make available any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
  7. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas (such as shopping) that are designated for such purpose
  8. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  9. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Interactive Area are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;
  10. interfere with or disrupt the Interactive Area or servers or networks connected to the Interactive Area, or disobey any requirements, procedures, policies or regulations of networks connected to the Interactive Area;
  11. intentionally or unintentionally violate any applicable local, state, national or international law, any rules of any national or other securities exchange and any other regulations having the force of law;
  12. provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
  13. "stalk" or otherwise harass another; and/or
  14. collect or store personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs a through m above.

The WNA does not and cannot review the content posted by users on this website and is not responsible for such content. However, the WNA reserves the right to delete, move or edit any content (including content posted in any Interactive Area) that it may determine, in its sole discretion, violates or may violate these Rules of Conduct or is otherwise unacceptable. users remain solely responsible for all their posted content. The WNA shall have the right but not the obligation, to correct any errors or omissions in any content, as it may determine in its sole discretion.
 
The WNA does not represent or endorse the accuracy or reliability of any content posted on any Interactive Area. Users must be aware of the fact that any reliance upon such content shall be at their sole risk. Any content placed on any Interactive Area by users are the views of the user posting the statement, and do not represent the views of the WNA or its advertisers or sponsors.
